Your dues providing funding for a variety of services, including:


  • Insurance

  • Dues Collection & Enforcement

  • Covenant Enforcement / Architectural Review

  • Clubhouse upkeep & repairs

Common Grounds:

  • Mowing and chemical treatments to HOA common grounds

  • Landscaping at the entry monument, center island and pool grounds

  • Operation of irrigation systems

Neighborhood Pool / Playground: 

  • Upkeep and maintenance of the swimming pool

  • Daily servicing/cleaning of the pool during the summer

In order to provide these services, it is important that all Foxberry Estates residents pay their annual dues. The Board of Directors takes the dues collection process seriously. Residents with outstanding dues will have liens filed against their properties, be denied access to the pool & clubhouse, and may face legal action to collect unpaid balances.


One of the great amenities in our community is the neighborhood pool. The pool provides an opportunity for neighbors to congregate, families to play, and friends to relax.
No matter how you use the pool, please be considerate of others and clean up after yourself, family, and guests.

A special thank you to those who have donated their time to ensure the pool is maintained for all to enjoy!

Reminder: Your HOA dues and any fines MUST be current in order to have access to the pool.


Pool Keys:

  • All homeowners should have an active proximity key card to access the pool area.

    • Only one (1) key card will be issued per household. 

  • If your key card is lost, a $15 fee will be charged to receive a new one. Your old key card will be deactivated.

Pool Rules:

Pool Hours: 8am - 11pm daily 
Occasional closing may be needed for cleaning, maintenance, etc. 
Anyone entering the pool area outside of hours of operation will be considered trespassing & will be subject to arrest.

*NO LIFEGUARD, swim at your own risk*

  • Anyone 14 years old or younger MUST be accompanied by responsible adult.

  • NO diving, running, pushing, dunking, rough play, or any type of personal conduct endangering safety of self & others is allowed.

  • NO food or drink in the pool.

  • NO glass containers are allowed in the pool area.

  • Pool gate MUST remained closed at all times.

  • NO smoking or chewing gum within the pool area.

  • NO animals (besides service animals) are allowed in the pool area.

  • NO one with an infectious disease, inflamed eyes, nasal/ear discharge, open wounds/bandages are allowed in pool.

  • NO private parties are permitted at the pool.

  • NO yelling, loud music, profane language, or offensive behavior is allowed in the pool area.

  • A maximum of five (5) guests, per household, are permitted at the pool.

    • Residents are responsible for making sure guests are aware of & abide by pool rules at all times.

  • ALL trash must be removed & placed in the trash container provided (under awning).​

  • In the event of severe or emergency weather (such as thunder/lightening), everyone MUST leave the pool.

  • Members must instruct their children and guest's children in personal hygiene (e.g., instruct them to use the restroom facilities) 

    • Infants are required to wear swim diapers in the pool.

  • ​The Homeowner's Association will not be responsible for any money or property loss sustained by members or their guests when using the pool.

  • Any resident (residents also responsible for guests) that breaks a rule and requires the pool to be closed for safety/sanitary reasons will be required to pay a minimum of $500.00 to cover the costs of restoring the pool/area to safe conditions. Additional fees may be assessed as needed.  Such resident’s pool privileges are suspended until payment is complete.

As a community, we're very fortunate to have a clubhouse for residents to use.  We would like to thank everyone in the neighborhood who has helped keep the clubhouse in great shape and ready for that next party!

Reservations of the clubhouse do NOT include usage of the pool or pool deck.
If your guests need a breath of fresh air, please have them step out front of the building.

At this time, we do not rent to non-residents.

Reservations are not considered final until the rental fee has been received in full.

We do not require a security deposit, as the homeowner assumes all responsibility for any & all damage.


This agreement is between Foxberry Estates HOA (27901 Foxberry Trail, Lees Summit, MO 64086) and the homeowner filling out the form:

It is agreed that any party using these premises will abide by the following rules and regulations and in return, Foxberry Estates HOA will make available the use of restrooms and kitchen facilities. This also includes tables and chairs. 

  • NO SMOKING ALLOWED inside the clubhouse. Receptacle provided outside of building.

  • Rental of the clubhouse does NOT include access to the pool or pool area.

  • Occupancy shall be limited to 150 people.

  • NO wall or ceiling decorations are allowed.

    • Table decorations are permitted.

  • The Clubhouse may be rented for a fee of $75.00 for Homeowners.

    • Rental period shall not exceed 6 hours, unless a special request is made at time of agreement.


    • The supervising adult must sign this agreement and understand that they will be held accountable for any damages that may occur.

  • All rentals must be concluded by 1:00 AM .

    • This includes clean‐up, unless a special request is made at time of agreement and noted here.

    • It is the homeowner's responsibility to schedule a check‐out time with a Board member within 24 hours of rental time.

  • Restriction of Use: The use of the clubhouse shall be limited to Foxberry Estates Homeowners in good standing (i.e., HOA dues paid in full), their guests and invitees.

  • Damages: Homeowner agrees to be responsible for the full cost of repair for any damage incurred during this rental. Failure to pay for the repair of damages may result in the HOA pursuing all legal recovery options up to and including placement of a lien placed against the homeowner’s property.

  • Clean Up: Homeowner shall clean the premises immediately following their rental. There are cleaning supplies in the pantry and storage closet for kitchen/bathroom clean up, and a vacuum for the carpeted areas. There is a cleaning checklist provided in the clubhouse that must be completed and signed. Refusal or failure to adequately clean the facilities will result in cleaning charges no less than $150 and could result in legal recovery options up to and including placement of a lien placed against the homeowner’s property.

  • Cancellation Policy: The Homeowner shall give notice of no less than 7 days of cancellation of reservation to receive 100% of their rental fee, 3 days for 75% of rental fee, and 24 hours for 50% of rental fee.

  • Disclaimer of Liability: The renting Homeowner releases Foxberry Estates HOA from any and all liability relating to the premises. The Homeowner agrees to and shall protect and hold harmless the Association from any and all liability for the loss from an accident resulting in bodily injury to or death to persons and for loss from an accident resulting in damage to or destruction of property.

The Architectural Review Committee (ARC) consists of volunteers within the neighborhood that work hand-in-hand with the Foxberry Estates Homeowner's Association Board of Directors. Its primary function is to review, on a case-by-case basis, the appearance, design, construction, modification to and maintenance of homes within Foxberry Estates. Collectively, the ARC members are the primary means for ensuring our community remains attractive now, and for years to come.

Every house is held to the same high standards of the Foxberry Estates Home Owners Association By-laws and Covenants, thereby ensuring that the entire community retains its value and premier status within the Kansas City area.

Whether you are a builder constructing a new home, or you are in an existing home and are considering an addition, re-roofing, repainting, or altering the exterior of your home in any manner – you will need to include the ARC into your plans.

Since the ARC has broad discretion in what it will approve or deny, good communication is essential for the ARC submission/review process to work smoothly.
We encourage all homeowners and/or your contractors to become acquainted with the Architectural Review Process at Foxberry Estates.

Please Note: While the goal is to review your request and reply to you as soon as possible, the expectation to process your request is within 30 days.
